1.0 Contract

1.1 These Terms and Conditions represent a legally binding contract between you as the Client and Popupnanny.nl
1.2 Acceptance of the Terms and Conditions by the Client takes effect immediately upon either completing the online booking form or giving us verbal or written instruction to book a service
1.3 The word "Client" refers to the person/family using Popupnanny.nl services
1.4 The word "Candidate" refers to any person that Popupnanny.nl introduces to the Client
1.5 The Agency is acting as an introductory agency and not an employment agency; therefore the Client employs the Candidate
1.6 The Terms & Conditions are the terms of which Popupnanny.nl offers the Client access to the services and use of Popupnanny.nl. By ordering with Popupnanny.nl, the Client agrees to abide by these Terms & Conditions

2.0 Client Responsibilities

2.1 Any correspondence, communication either verbally, written or via email is confidential and the Client agrees not to disclose to third parties
2.2 All bookings must be made directly between the Client and Popupnanny.nl
2.3 No bookings are to be made directly with the candidate unless previously agreed with Popupnanny.nl. Should this obligation be ignored, the candidate is obliged to inform the Popupnanny.nl and the relevant fees will be charged to the Client.
2.4 The Client will notify the agency immediately of any extension of any temporary placement and agrees further placement fees will apply
2.5 If a Client wishes to employ a specific Candidate originally introduced by Popupnanny.nl on a long term or regular basis, then Popupnanny.nl should be notified in advance.
2.6 Popupnanny.nl requires the Client to provide accurate details of their full name, contact details and address.
2.7 Popupnanny.nl requires the Client to inform the Candidate (including, but not limited to, nannies, housekeepers, cooks, gardeners, drivers, and caregivers for children or the elderly) of any medical conditions, allergies, illnesses, or disabilities related to the family or household that may affect the Candidate’s duties
2.8 The Client confirms that the employment relationship exists solely between the Client and the Candidate, and not the popupnanny.nl.
2.9 The Clients that employ a candidate are required to abide by all tax laws.
2.10 The Client is responsible for holding adequate household insurance in the Netherlands, including liability insurance, to ensure appropriate coverage for domestic staff working in the home in case of accidents, injury, or damage arising during the course of their duties.
2.11 The Client agrees that Popupnanny.nl requires our Candidates to be in a safe and friendly environment
2.12 Where Popupnanny.nl (in its absolute discretion) believes that there is sufficient negative feedback or feedback is of a concerning nature regarding the Client, then Popupnanny.nl will refrain from referring any candidate
2.13 The Client is responsible for paying all expenses during the Candidates working hours, including but not limited to travel expenses, admission or entrée costs for activities, food and drink and any other related costs that are incurred during the Candidates working hours
2.14 If the Client ends the booking early, the full hours originally paid are not refundable.
2.15 If the booking runs longer than the original hours booked, the Client agrees to pay the Candidate overtime, rounding up to the nearest 15mins in cash according to agreed hour rate at the end of candidate's service directly.
2.16 If a Candidate leaves a booking after 11.30pm the Client agrees to pay for a taxi home to ensure the Candidates safe return

3.0 Fees

3.1 Booking fees are payable in Euro
3.2 The recruitment fee is calculated based on the Candidate’s net monthly salary or, in the case of short-term bookings, on the total salary for the full contract period.
3.3. Regardless of whether the Candidate is engaged on a live-in or live-out basis, the following payment structure applies:
a) 20% of the recruitment fee (+ VAT) is payable before the search commences. This payment is non-refundable.
b) The remaining 80% of the recruitment fee (+ VAT) is payable after the Candidate has commenced employment.
3.4 The booking should be paid prior to the Candidate commencing work. Popupnanny.nl holds the right to cancel a Candidate if the booking has not been received prior to the Candidate service.
3.5 The invoice will be sent via email with payment due upon receipt
3.6 The guarantee period for the Candidate is one (1) month from the Candidate’s start date.
3.7 For urgent requests, an additional fee of €50 applies. Urgent requests must be paid in full (100%) prior to the commencement of services and are non-refundable.
3.8 The Candidate’s salary is agreed directly between the Client and the Candidate, based on the Client’s requirements and financial capability. Approximate salary ranges are available in the FAQ section of the website.
3.9 All salary payments are made directly by the Client to the Candidate. The Agency does not act as the employer and bears no responsibility for salary payments.
3.10 The booking is based upon the original dates requested. Should those dates be shortened, no agency fee refunds will be given
3.11 The Client shall notify the popupnanny.nl immediately should it choose to re-engage a Candidate who has been introduced to it by the popupnanny.nl
3.12 If the Client engages the Candidate for more hours than initially booked through Popupnanny.nl, the Client agrees to pay a fee of €2,500. Upon payment of this fee, the Client is permitted to hire the Candidate on a permanent basis (Permanent Placement Fees)
3.13 In the event of a Client passing the details of a Candidate to third parties, the Client will be responsible for any relevant Popupnanny.com Fees and associated loss of Popupnanny.com earnings
3.14 In the event that a Client does not hire a Candidate following the initial Introduction by the Popupnanny.com but subsequently approaches the Candidate directly (not through the Popupnanny.com) offering engagement then the Client shall be liable to relevant Permanent Placement Fees

4.0 Cancellation

4.1 No refunds will be given for urgent bookings.
4.2 Cancellations made within 24 hours of the scheduled start time are non-refundable. Cancellations made earlier than 24 hours before the start time are eligible for a full refund.
4.3 A full refund will be provided if the booked Candidate cancels or fails to show up, and no suitable replacement Candidate can be arranged.

5.0 Liability

5.1 Popupnanny.nl acts as an agent for the Client, not as an employer of the candidate. Therefore the agency accepts no liability or responsibility for accident, injury, loss, damage or misconduct sustained by Candidates, Clients or any other persons and by employing a Candidate through Popupnanny.nl, The Client agrees to exclude the agency should any mishap occur
5.2 Popupnanny.nl endeavors to validate the background of our Candidates. We cannot guarantee that all the information is correct. Popupnanny.nl conducts thorough checks and conducts interviews.
5.3 Although Popupnanny.nl has high expectations of our Candidates and we aim to provide you with exceptional Candidates there is still no complete guarantee of reliability, honesty and character of the Candidate provided by the agency. Any concerns, please contact us immediately.
5.4 The Client is responsible for ensuring that their home contents insurance includes cover for Employers and Public Liability insurance for domestic workers, including childcare
5.5 The Popupnanny.nl does not accept any liability for any kind of inconvenience, loss or damage howsoever arising and whether caused directly or indirectly from an act or omission of a Candidate introduced by Popupnanny.nl. Similarly, no warranty is offered in respect of the suitability, honesty, capability or character of any Candidate introduced by the Agency and employed or contracted by the Client. Candidates are not the employees of the Popupnanny.nl
5.6 While a Candidate is providing services for a Client from an introduction made by Popupnanny.nl the Client undertakes to reimburse Popupnanny.nl fully for all costs, claims, damages, and liabilities whatsoever arising from the Client's wrongdoing or negligence

6.0 Confidentiality

6.1 All communication between both parties (Popupnanny.nl & Clients) shall remain confidential
6.2 Popupnanny.nl requires the Client to provide accurate details of their address, contact details and full name
6.3 We may contact Clients by email, text, or phone regarding any matters related to their bookings. Outside of arranging our services, Popupnanny.nl will always keep your email, phone number, and other personal information strictly confidential.

8.0 Warranties and Indemnities

8.1 The Client is not, and will not represent themselves as, an agent of Popupnanny.nl, and no warranty is provided regarding the suitability, honesty, capability, or character of any Candidates.
8.2 The Client is fully responsible for employment and/or contracting arrangements with the Candidate and all or any legal responsibilities owed by them to the Candidate including without limitation any employment obligation or contractual responsibilities
8.3 The Client will hold Popupnanny.nl harmless against any claims arising out of any claims brought against it arising from the Client's dealings with and treatment of the Candidate howsoever arising

9.0 Disputes

9.1 Popupnanny.nl prefers to resolve any disputes via mediation. Please contact us for full details.
Popupnanny.nl ("we" or "us" or "our") respects the privacy of our users ("user" or "you"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the "Site"). Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the site.

Personal Data

Personally identifiable information, such as your name, email address, and telephone number, and demographic information, such as your age, gender, family status, home address, and interests, that you voluntarily give to us when you register with the Site, or when you choose to participate in various activities related to the Site, such as online chat and message boards. You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Site.

Derivative Data

Information our servers automatically collect when you access the Site, such as your IP address, your browser type, your operating system, your access times.

Financial Data

Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the Site. [We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor PayPal and Stripe, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Site to:
